By engaging with West Peak Digital ("we", "our", "us") for any digital marketing, advertising, automation, or related services, you ("Client", "you") agree to be bound by the following terms and conditions. These terms apply to all services provided unless otherwise stated in a signed agreement.

2. Services Provided

We offer a variety of digital marketing and automation services, including but not limited to:

  • Search Engine Optimization (SEO)
  • Google Ads Campaign Management
  • Google Business Profile Optimization
  • AI Voice Agents & Automation Tools
  • Website Design & Development
  • Marketing Dashboards (upcoming feature)

All services will be outlined in detail in your proposal or invoice.

3. Payment Terms

  • All projects require a deposit or initial setup fee, as specified in your service agreement or invoice.
  • Monthly services are billed in advance, due on the same day each month unless otherwise agreed.
  • Late payments may result in a suspension of services and/or a late fee of 5% per month.
  • All payments are non-refundable unless explicitly stated in writing.

4. Contract Terms & Cancellation

  • Unless specified otherwise, service agreements operate on a 6-month minimum term, after which they convert to month-to-month.
  • You may cancel any recurring services after the minimum term by giving 14 days' written notice.
  • We reserve the right to terminate service for abuse, non-payment, or breach of these terms.
  • If services include ad spend (e.g. Google Ads), Client is responsible for all platform fees paid directly to the advertising network.

5. Performance & Results Disclaimer

While West Peak Digital uses proven strategies, we do not guarantee specific rankings, traffic, or sales. Digital marketing success depends on many variables, including your industry, competition, budget, and market demand.
We strive for measurable results, but no refunds will be provided based on perceived or actual performance unless explicitly agreed in writing.

6. Intellectual Property

  • All custom content, website designs, ad creatives, and strategy documents remain the intellectual property of West Peak Digital until your account is paid in full.
  • AI automation and proprietary software tools are licensed, not sold, and remain the property of West Peak Digital or its licensors.

7. Client Responsibilities

You agree to:

  • Provide timely feedback, approvals, and assets as requested.
  • Grant necessary access to platforms (e.g. Google Business Profile, website, ad accounts).
  • Not interfere with campaigns without coordination with our team.
  • Maintain accurate contact and billing information.

Delays or poor performance due to failure to cooperate will not be West Peak Digital’s responsibility.

8. Confidentiality

We agree to keep your proprietary information confidential. You agree not to reverse-engineer or disclose any proprietary strategies, scripts, or tools we use.

9. Limitation of Liability

West Peak Digital will not be held liable for indirect, incidental, or consequential damages, including lost profits or missed opportunities. Total liability shall not exceed the amount paid by the Client in the past 90 days.

10. Revisions & Scope Changes

Any changes outside the scope of the agreed project may incur additional charges. We will provide a quote before proceeding with any extra work.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes shall be resolved in Los Angeles County courts.

12. Updates to Terms

We reserve the right to modify these Terms & Conditions at any time. The most recent version will always be available on our website and take effect upon publication.
